Creditors’ Rights and denial of Claims
Do you have an invoice which the debtor is not paying, even though you have sent a reminder notice? Then it is time to send a debt collection notice. After the debt collection notice, the next step is that the creditor (the person who should have been paid) applies for payment at the Kronofogden (Swedish Public Collection Authority). You can do this if the invoice has not been disputed.
The Kronofogden demands the debtor pay the debt. If the debtor does not pay, then the enforcement officer issues a ruling comparable to a judgement made by court. If the debtor contests the matter, it will be submitted to the court. This is called a summary procedure. This term refers to a simplified, fast and efficient procedure to establish proof of debt. The creditor shall, without excessive expense and without having to go to court, obtain evidence for his claim.
It may be that you want to contest a claim that you have received. How should you go about it? The debt collection claim may be incorrect. Maybe you have already paid, or maybe you did not order the product. The demand could be invalid (so old that the demand no longer applies). How do you go about contesting the demand? If you wish to have the demand tried in court, what do you do then? www.kronofogdemyndigheten.se
